NOTICE TO PURCHASER: LIMITED LICENSES



1. Elitech Dyes

Use of this product is covered by patents owned by ELITechGroup, Inc., including but not limited to the following US patents and corresponding patent claims outside the US: 8,008,522 and 8,389,745. This product, including both Research Grade Product and IVD Grade Product, is sold under a licensing arrangement with ELITechGroup, Inc. for the purchaser’s own internal research. Commercial use of this product requires a separate license from Kaneka Eurogentec S.A. Further information on purchasing licenses may be obtained by contacting licensing@eurogentec.com.

2. UDG

Use of UDG employs patent rights licensed from Invitrogen Corporation.

3. SYBR® Green I nucleic acid gel stain

This product is provided under a technology agreement from Life Technologies Corporation to Kaneka Eurogentec S.A. The sale of this product is conditioned on the buyer using the product only in research conducted by the buyer and not to sell or otherwise commercialise this product or its components (1) in manufacturing; (2) to provide a service, information, or data in exchange for payment; (3) for therapeutic, diagnostic or prophylactic purposes; or (4) for resale, not even if resold for use in research. 4. Alexa Fluor®, BODIPY®, Cascade Blue®, Marina Blue®, Oregon Green®, Pacific Blue™, QSY®, Rhodamine Red™ Texas Red® dyes

This product is provided under an intellectual property license from Life Technologies Corporation. The transfer of this product is conditioned on the buyer using the purchased product solely in research conducted by the buyer, excluding contract research or any fee for service research, and the buyer must not (1) use this product or its components for (a) diagnostic, therapeutic or prophylactic purposes; (b) testing, analysis or screening services, or information in return for compensation on a per-test basis; or (c) manufacturing or quality assurance or quality control, and/or (2) sell or transfer this product or its components for resale, whether or not resold for use in research. 5. CAL Fluor™ and Quasar™

CAL Fluor™ and Quasar™ dyes are trademarks of Biosearch Technologies, Inc., Novato, California, U.S.A. (‘BTI’). Patents are currently pending for the CAL Fluor™ and Quasar™ dye technology and such CAL Fluor™ and Quasar™ dye technology is licensed pursuant to an agreement with BTI and these products are sold exclusively for research and development use only. They may not be used for clinical or diagnostic purposes and they may not be re-sold, distributed or re-packaged.

6. C-5 Propyne and G-clamp modified oligonucleotides

C-5 Propyne and G-clamp modified oligonucleotides are covered by patents or patents pending owned by Isis Pharmaceuticals, Inc. (“Isis”). Purchase of this product includes a limited license to use this product solely for internal research. This license specifically excludes (and you have no right to use this product for): (a) therapeutic or diagnostic applications (including products or services that incorporate this product), (b) any in vivo toxicity/safety study in support of an investigational new drug application (or foreign counterpart), (c) resale (including sale of any products or services that incorporate this product) or (d) gene functionalization activities (including products or services that incorporate data derived from gene functionalization activities) if such activities have commercial application, any and all of which require a separate license from Isis. Neither this product nor any product created through its use may be used in human clinical trials. In the event you have a separate agreement with Isis regarding this product which explicitly states that the foregoing is not applicable to you, your use of this product will be governed by the terms of such agreement. In no event does the limited license included with the purchase of this product expand or alter the scope of the license granted pursuant to such agreement.

7. Hilyte™ Fluor Dyes

Use of this product is covered by one or more of the following US patents owned by AnaSpec, Inc.: USP 7,465,810, USP 7,754,893, USP 7,820,783, USP 8,258,292, and divisionals, continuations, continuations-in-part, reissues, substitutes, and extensions thereof. The purchase of this product conveys to the buyer a limited, non-exclusive, nontransferable right (without the right to sell, repackage, or further sublicense) under these patent rights to use only the amount of product purchased for the purchaser’s own internal research. No other license is granted to the buyer whether expressly, by implication, by estoppel or otherwise. In particular, the purchase of this product does not include nor carry any right or license to use, develop, or otherwise exploit this product commercially, and no rights are conveyed to the buyer to use the product or components of the product for any other purposes, including without limitation, provision of services to a third party, generation of commercial databases, or clinical diagnostics or therapeutics. This product is for research use only. For information on purchasing a license to this product for purposes other than research, contact licensing@eurogentec.com.

8. QXL® Quenchers

Use of this product is covered by one or more of the following US patents owned by AnaSpec, Inc.: USP 7,910,753, USP 8,093,411, and divisionals, continuations, continuations-in-part, reissues, substitutes, and extensions thereof. The purchase of this product conveys to the buyer a limited, non-exclusive, nontransferable right (without the right to sell, repackage, or further sublicense) under these patent rights to use only the amount of product purchased for the purchaser’s own internal research. No other license is granted to the buyer whether expressly, by implication, by estoppel or otherwise. In particular, the purchase of this product does not include nor carry any right or license to use, develop, or otherwise exploit this product commercially, and no rights are conveyed to the buyer to use the product or components of the product for any other purposes, including without limitation, provision of services to a third party, generation of commercial databases, or clinical diagnostics or therapeutics. 9. SensoLyte® assays and assay kits

Use of this product is covered by European Patent 1243658, US Patents 7,033,778 and 7,256,013 and their foreign counterparts, and licensed to AnaSpec, Inc. by CycLex Co. Ltd.

10. Peptides # 61253 Pep-1 and 63849 Pep-1 as well as dye-labeled and biotin-labeled versions

Use of this product is covered by US Patent No. 6,841,535.

11. Apstatin peptide

Use of this product is covered by US Patent No. 5,656,603.

12. FRETS-VWF73 and any kits containing FRETS-VWF73

Use of this product is covered by US Patent 7,718,763 and by Japan Patent 3,944,586, and licensed by the National Cerebral and Cardiovascular Center.

13. Duplex Stabilizing Quencher

Use of this product is covered by patents owned by ELITechGroup, Inc., including but not limited to the following US patents and corresponding patent claims outside the US: US 10,677,728, US 2020/0173924 A1 and EP 3668884 A1. This product, including both Research Grade Product and IVD Grade Product, is sold under a licensing arrangement with ELITechGroup, Inc. for use by purchaser only in human in vitro diagnostics applications to provide information for individual patient management solely using 5’ nuclease technology. Commercial use of this product requires a separate license from Kaneka Eurogentec S.A. Further information on purchasing licenses may be obtained by contacting licensing@eurogentec.com.

14. MGB Pleiades Probes

Use of this product is covered by patents owned by ELITechGroup, Inc., including but not limited to the following US patents and corresponding patent claims outside the US: US-2009-0048427-A1 and US 7,381,818. This product, including both Research Grade Product and IVD Grade Product, is sold under a licensing arrangement with ELITechGroup, Inc. for the purchaser’s own internal research.
